1. Purpose

These Terms of Service (the "Terms") govern your access to and use of the website https://boatmap.app and the mobile application BoatMap (together, the "Service"), published by MOQA STUDIO, a Société par Actions Simplifiée (SAS) with a share capital of 1 000 €, registered office at 10 rue Émile Duclaux, 75015 Paris, France, registered under RCS Paris 984 885 350 (hereinafter, "we", "our" or the "Publisher").

By creating an account or otherwise using the Service, you (the "User") accept these Terms in full. If you do not accept these Terms, you must stop using the Service.

2. Description of the Service

BoatMap is a recreational boating navigation application that allows Users to:

  • view nautical charts and points of interest;
  • discover marinas, anchorages, boat ramps and fuel stations;
  • record GPS tracks of their trips;
  • access marine weather, post reviews and create lists of favourite spots;
  • share content with the community (photos, reviews, tracks).

The Service offers a free tier and may, in the future, offer one or more paid plans (the "Premium" plans).

3. Safety Notice - Navigation Aid Only

BoatMap is a navigation aid intended solely for recreational use. The Service does not replace official nautical charts, hydrographic office publications (SHOM, NOAA or any other competent authority) or the statutory navigation equipment required on board.

The data displayed (charts, depths, buoys, weather, points of interest, reviews) may be inaccurate, incomplete or outdated. It is the sole responsibility of the master of the vessel to verify this information against official sources, to assess actual navigation conditions (weather, sea state, visibility, condition of the vessel and crew) and to take all appropriate safety measures. The master remains solely responsible for the operation of the vessel and for the safety of persons and goods on board.

The Publisher shall not be liable for any accident, bodily injury, material damage, grounding or any consequence whatsoever resulting from a navigation decision made on the basis of the Service.

4. Access to the Service and Eligibility

The Service is available to natural persons aged 16 or over with the legal capacity to enter into a contract. Underage users must obtain the prior consent of a parent or legal guardian.

Access to the Service requires the creation of an account. You agree to provide accurate information and to keep your profile up to date. You are responsible for maintaining the confidentiality of your credentials and for any activity carried out from your account.

5. User Obligations

You agree to:

  • use the Service in good faith and for its intended purpose;
  • comply with all applicable laws and regulations (including, without limitation, navigation rules, maritime rules, marine protected areas and environmental law);
  • refrain from publishing unlawful, offensive, defamatory, racist, sexist, homophobic, violent or sexual content, or content that infringes the privacy of others;
  • refrain from posting false information that may endanger the safety of navigation;
  • refrain from circumventing security measures or from scraping data;
  • respect the privacy of other Users;
  • refrain from using the Service for commercial purposes without our prior written consent.

6. User Content

You are solely responsible for the content you post through the Service (reviews, photos, GPS tracks, lists, comments, etc. - "User Content"). You warrant that you hold all rights necessary to post such content.

By posting User Content, you grant the Publisher a non-exclusive, royalty-free, worldwide licence, for the legal duration of copyright protection, to reproduce, display, adapt, translate and distribute such content in the context of the Service and its promotion, on any medium and by any means known or to be known.

We reserve the right to remove, without prior notice, any User Content that breaches these Terms, the law or the rights of third parties.

7. Intellectual Property

The Service, its components (interface, code, design, logo, name, trademarks, databases) and the content integrated therein (excluding User Content and third-party content) are the exclusive property of the Publisher and are protected by intellectual property law.

Nautical charts, aids to navigation data and related data remain the property of their respective owners (SHOM, NOAA, OpenSeaMap, OpenStreetMap, Mapbox, etc.).

8. Paid Plans (Premium)

Certain features may, in the future, be reserved for Users with a Premium subscription. Pricing, duration, renewal and cancellation terms will be presented at the time of subscription.

In accordance with Article L.221-28 of the French Consumer Code, by expressly agreeing to the immediate performance of a digital content service, you acknowledge losing your right of withdrawal for digital content already supplied.

9. Liability

The Service is provided "as is" and "as available". We use reasonable efforts to ensure that it functions properly, without warranting that it will be continuous, uninterrupted or error-free.

To the fullest extent permitted by law, the Publisher's liability is limited to direct, foreseeable and proven damages suffered by the User. The Publisher shall not be liable for:

  • any nautical accident, bodily injury, material or immaterial damage resulting from the use of the Service;
  • any loss of data, including GPS tracks, caused by a malfunction of the phone, network or Service;
  • any interruption or unavailability of the Service (maintenance, force majeure, third-party intervention, etc.);
  • the content or behaviour of another User.

10. Personal Data

Personal data processing is described in our Privacy Policy, which forms an integral part of these Terms.

11. Termination

You may delete your account at any time from the application settings or by writing to us at hello[at]boatmap.app.

We reserve the right to suspend or terminate your account, without prior notice, in the event of a serious or repeated breach of these Terms, in particular where a behaviour endangers the safety of other Users.

12. Changes to the Terms

These Terms may be amended at any time. The version in force is the one published on the Service at the date of your use. In the event of a material change, we will notify you by email or through the Service with reasonable notice.

13. Applicable Law and Dispute Resolution

These Terms are governed by French law. In the event of a dispute, the User is invited to contact us at hello[at]boatmap.app in order to seek an amicable solution.

In accordance with Article L.616-1 of the French Consumer Code, a consumer User may use a consumer mediator free of charge:

The User may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Failing an amicable resolution, the French courts shall have exclusive jurisdiction, subject to the protective provisions of consumer law.
